OHIO SUPREME COURT CANDIDATES AT THE FAIR 8/16/16


ZANESVILLE, Ohio– The race for Ohio Supreme Court makes a stop at the Muskingum County Fair.

Appellate Court Judge Pat DeWine says

“I’m a constitutional conservative” “I believe a judge should apply the law as it’s written not legislate from the bench.”

Judge Pat Fischer also made an appearance at the fair. Fischer is also running for Supreme Court Justice.

“I used to be on the Hamilton County Mental Health and Recovery Services board,” Judge Fischer said. “I know from talking to the sheriff you guys have the same problems we do. You got to have judges who understand that drug addiction and mental health problems.”

Fischer is running against democrat John P. O’Donnell, while DeWine faces democrat Cynthia Rice.

High court candidates say they won’t write law from the bench 8/1/16


MANSFIELD – Two Cincinnati-based candidates running for seats on the Ohio Supreme Court  told Richland County Republican Party members Monday they would uphold the constitution as the founders envisioned it and would not write new law from the bench.

Both won endorsements from local Republican party members before the end of the party’s monthly luncheon at Ed Pickens’ Cafe on Main.

“My opponent says she believes in a ‘living’ constitution,” said Appellate Court Judge Pat DeWine, who faces Cynthia Rice on the Nov. 8 ballot.

Either DeWine or Rice will will replace Justice Paul Pfeifer, a Republican from Bucyrus who has served on the court since 1992, but must retire in 2016, having reached mandatory retirement age.

Pat DeWine, the son of Ohio Attorney General Mike DeWine, said he believes it’s up to judges to follow the Constitution, and up to “the people…not the judges” to make any amendments to that. “We have too many justices in this country that believe their role is to make the law,” he said.

DeWine previously served as a Cincinnati city council member and Hamilton County commissioner, and was a former trial judge who currently sits on the First District Court of Appeals.

He told party members one of his major concerns during his career has been the high cost of lawsuits. Too often, people are stuck in court, their lives put on hold by lawsuits that are unwarranted but drag on and on. “Getting rid of frivolous litigation has been one of my priorities,” he said.

Local Republicans also heard from Pat Fischer, who is facing off against Democrat John P. O’Donnell, for the seat now held by Justice Judith Lanzinger, a Republican.

Fischer, a former president of the Ohio State Bar Association, was appointed by the late Chief Justice Thomas Moyer to co-chair a task force to make the judicial system more efficient, and was named one of the Top Lawyers in Ohio. He has served on the First District Court of Appeals since 2010.

He told Republicans he worked hard late into Democrat John Kerry’s presidential campaign, litigating efforts by Democrats to block Republican observers from Ohio voting precincts. Last-minute legal arguments had proceeded through three courts, when the U.S. Supreme Court voting shortly before polls opened, with an opinion that “went my way,” staying the ban, he said.

“I too am a strict constructionist, to the point that my law clerks get mad at me,” Fischer said. He said he believes judges should interpret what has been written, not legislate from the bench. In making a ruling, “we literally will diagram a sentence, see that the sentence really means – and that’s it,” he said.  “What I personally believe doesn’t matter. There are many laws I don’t agree with.”

Fischer said some have called him a “boring” candidate – and that’s “a good thing.” When asked whether there is anything embarrassing in his past, “My answer is ‘no.’ he said “I have one wife, one daughter, one dog, and I’m loyal to all three. My wife and daughter are loyal to me, and if I keep feeding that dog, it’ll be loyal, too.”

Remarks during the luncheon frequently were on the light side. DeWine ended his talk saying as the father of five teenagers, he “has lots of experience adjudicating disputes.”

“I’m the mother of two teenagers – so God bless you,” Richland County Republican Party chairwoman and county commissioner Marilyn John responded.

John reminded party members that judicial candidates’ political affiliations won’t directly be listed on the Nov. 8 ballot, so it was important for staunch Republicans to remember the candidates’ names “and educate others around us” on down-ticket choices below those for president.

Happy Father’s Day!


I’m Grace Dayton, Pat DeWine’s step-daughter. I’ve known Pat since I was 5, and in celebration of Father’s Day I wanted to share with you a few reasons why he is both a great dad and a great public servant for Ohio!

 

5) His passion is inspiring! Pat has served as a city councilman, county commissioner, and as both a trial and appellate judge. He loves going to work every day to help people and make our community better.

 

4) He makes time for us! Even though Pat’s campaign takes him all over the state, he makes it a point to be back to Cincinnati to spend time with us whenever he can. He takes Mom to concerts, loves to grill and cook for us, and just last week hurried home to take me, Mom and my friends out for my 15th birthday!

 

3) His dedication! Pat graduated Miami University with a 4.0 GPA. As a current student I know that takes a lot of hard work! Pat also finished in the top of his class in law school, and was one of the best marathoners in Ohio (when he was quite a bit younger!). Pat’s dedication to keeping his court docket moving and giving people the respect and justice they deserve makes him an outstanding judge.

 

2) Family! When Mom married Pat I suddenly got so many new aunts, uncles and cousins — the DeWine family is huge! Watching how Pat cares for all of us is a window into how much he appreciates people and respects each individual’s God-given talents and abilities.

 

1) He has 5 teenagers! I’d like to think that the regular in-home training we’ve given Pat has made him quite a bit better at sorting through some tough arguments as a judge ;-). I have no doubt he’ll make an outstanding Justice for Ohio!

Ohio Supreme Court candidate visits Defiance, Wauseon 6/10/16


An Ohio Supreme Court candidate spent part of Wednesday visiting northwest Ohio.

Pat DeWine — son of Ohio Attorney General Mike DeWine, a first-term judge on Ohio’s 1st District Court of Appeals in Cincinnati and former Hamilton County Common Pleas Court judge — is one of two candidates seeking the seat to be vacated by Justice Judith Lanzinger. (Lanzinger must step down due to mandatory age limitations because she turned 70 this year.)

On Wednesday, DeWine visited Toledo, spoke at a Wauseon Rotary Club lunch event and met with Republicans in Defiance at the law offices of Weaner, Yoder, Hill and Weber, Ltd., where he provided an exclusive interview to The Crescent-News.

DeWine has been campaigning for awhile, noting that he visited all of Ohio’s 88 counties last year. Although there are some things he doesn’t enjoy about campaigning for the supreme court, he doesn’t seem bothered by it generally.

“I think that the ability to elect the Ohio Supreme Court is an important right people in Ohio have,” he said. “I think that’s a good thing that we’re accountable to the people. There’s parts of it I don’t like … . I don’t like being in the car for four hours, but the actual part like going out and talking to people, meeting people, I think gives you a perspective that if you just sit in your office and don’t ever go out to talk to people you don’t have. You learn a lot when you talk to people.”

How does he describe himself philosophically?

“I call myself a constitutional conservative,” DeWine stated. “I’m someone who believes the role of a judge is to apply the law as it’s written. I don’t believe in legislating from the bench. I don’t think judges’ role is to make the law. The role of a judge is to apply the law as it’s written. I think we do that by looking at what is the text of the law in front of us and applying the literal meaning of those words.”

He believes this sets him apart from his opponent, Cynthia Rice, a Democrat.

“From a philosophy standpoint, she’s been quoted as saying that she believes in a living constitution which I think means that you believe the constitution changes over time … ,” said DeWine. “I believe we ought to apply the language of the constitution, and if people want to amend the constitution there’s a process … to do that, but I don’t think judges should be the ones amending the constitution.”

DeWine brushes aside an unflattering rating from the Ohio State Bar Association in February, calling it political. While Rice received a “highly recommended” designation, DeWine was given a “not recommended” rating.

“Unfortunately, that was a very political process I think,” he said. “If you compare our resumes and backgrounds, what you’ll see is that I have much broader experience than what she does. She’s been an appellate judge, but I have been both a trial court judge and an appellate judge. In addition to that, I’ve been a (Hamilton) county commissioner, (Cincinnati) city council person, so I understand how the decisions we make in the judiciary impact the lives of real people in the other branches of government.”

Does name recognition — boosted by his father’s time as lieutenant governor, two terms as a U.S. senator for Ohio and current term as attorney general — help him?

“I don’t know,” he said. “I think certainly it’s not a bad thing, it’s a familiar name, but I think ultimately people are going to make their own decisions.”
